Protection of shipowner in a conflict with bunker supplier in relation to payment for fuel.
Regulatory agreement
Marine trading vessel which was chartered for a voyage with cargo of steel pipes, had been arrested in port of Hammerfest (Norway) by demand of English bunker company.
Decision
Negotiations were performed with claimants about settlement of claim due to high degree of doubtfulness and economic inexpediency of the claim. Regulatory agreement was developed with bail from cargo receiver. The vessel was released from arrest in 3 days which were considered to be a reserve before the intended voyage.

Settlement of conflict after grounding of the vessel
07/06/2009 in 12.15 pm a marine trading vessel had been grounded in Tarhalsen. The reason for grounding was that sailor on watch had fallen asleep on duty.
Decision
Regulatory agreement was developed in relation on insurable accident with immediate payment of 75% compensation of repairs to shipyard in Norway.

Forcing the insurance company to pay insurance compensation under the written guarantee.
Collection of shipowner’s share in General Average
The vessel with cargo of fertilizers had been grounded near Greek islands and received partial damage to hull as a result of actions to lift the vessel, including the breakage of main engine. Shipowner had proclaimed General Average. The insurer of cargo owner as security for General Average payments had handed out a guarantee average bond for 250 000 EURO. The shipowner demanded payment under the bond with attached dispatch report, but insurer refused to pay.
Decision
Order of bringing the claim was observed. Arrest of marine vessel in debtor’s ownership (cargo owner’s) was done on the territory of Russia. Points of claim were prepared to be brought to LMAA against cargo owner. Regulatory agreement was developed and signed at the stage of vessel’s arrest in Novorosijsk.
