The shipowner had asked for evaluation of legal risks in contract for repairs of vessel’s boiler with Estonian ship repair yard.
Decision
In the period of 48 hours before vessel’s arrival into port for repairs (Tallinn, Estonia), unnecessary risks of shipowner in repair performance were negotiated and eliminated, including breaches of applicable standards, delay in performance of works, increase in price.

Collection of share of shipowner in General Average
Marine trading vessel with cargo of fertilizers wa grounded near Egyptian coast with partial damage to hull and, as a result of attempts to unground the vessel, the engine suffered breakage. The shipowner proclaimed General Average. Cargo owner's insurer had handed out average bond for 250 000 Euro, but on demand from the shipowner with survey report included, no payment was made. The aim was to collect the damages from General Average, to get insurance compensation.

Decision
Terms of contract have been edited and have been made correspondent to a mechanism of payment for the project. Financial and organizational risks present in the contract have been eliminated. The contract has been made correspondent to rules of English law. Radically different draft of contract has been prepared and signed by the shipowner as a result. The planned deadline for delivery of vessel – autumn of 2013.

The shipowner has taken a decision to sub charter the vessel in time charter while it is in bareboat charter registry of Russia.
Decision
Corrections and additions have been made into bareboat charter contract in relation to possibility to subcharter the vessel into time charter. A demise charter was developed, vessel kept the Russian flag.
