Collection of shipowner’s share in General Average
The vessel with cargo of fertilizers had been grounded near Greek islands and received partial damage to hull as a result of actions to lift the vessel, including the breakage of main engine. Shipowner had proclaimed General Average. The insurer of cargo owner as security for General Average payments had handed out a guarantee average bond for 250 000 EURO. The shipowner demanded payment under the bond with attached dispatch report, but insurer refused to pay.
Decision
Order of bringing the claim was observed. Arrest of marine vessel in debtor’s ownership (cargo owner’s) was done on the territory of Russia. Points of claim were prepared to be brought to LMAA against cargo owner. Regulatory agreement was developed and signed at the stage of vessel’s arrest in Novorosijsk.

The shipowner has announced general average. Insurance company of cargo owner as a security in general average has handed out a guarantee in amount of 250 000 Eur. The shipowner has addressed the insurer with demand for payment with addition of dispatch report note, but insurer has refused to pay.
