Decision
Terms of contract have been edited and have been made correspondent to a mechanism of payment for the project. Financial and organizational risks present in the contract have been eliminated. The contract has been made correspondent to rules of English law. Radically different draft of contract has been prepared and signed by the shipowner as a result. The planned deadline for delivery of vessel – autumn of 2013.

Settlement of debt for payment for bunker fuel supply
Settlement of debt for payment for bunker fuel supply to the vessel “Aktiva” (IMO: 7408873).
Settlement of debt for payment for bunker fuel supply
Bunker fuel supplier company has supplied goods on the vessel “Aktiva” (IMO: 7408873). Out of original prime documents, the company only possessed a protocol of check of debt, and invoice and bunker delivery receipt. There was no contract, application or other documents available. The company has addressed us for legal assistance to collect the debt.
Decision
Prime documents as evidence of occurrence of debt have been re-established. Pre-arbitration negotiations have taken place in order to confirm the amount of debt as per size and rules of law. A claim has been delivered to court and settlement agreement for half-year delay in payment of debt has been concluded.

Leaseback of five tanker vessels
Leasing company has addressed us for legal assistance in drafting of contracts for sale and purchase of mixed river-sea vessel and editing of standard terms of leasing. Company needed to secure regulation and allocation of specific risks in leasing operations with vessels. The seller and lessee was the same person (leaseback). Objects of leasing were five tanker vessels: m/v «Laura» (IMO 8226466), m/v «Neman» (IMO 8843006) and three tanker vessels m/v «Nefterudovoz-44M» (IMO 8136714), m/v «Nefterudovoz-50M» (IMO 8726155), «Nefterudovoz-456M» (IMO 8726210).
Decision
In two weeks period activity has been started to draft five contracts of sale and purchase of tanker vessels and to edit standard form terms of leasing. With consideration of working practice of the company, all specific risks in relation of leasing of vessels have been managed.
