Legal evaluation of the case about collection of debt for maritime agency services to vessel “Glory” / “Lotta”
Issuance of legal report on presence / absence of grounds for annulment of decision of court of first instance on the case of collection of debt for maritime agency services, including justification as per rules of law and evaluation of evidence, and on possibilities of arrest of vessel “Glory” / “Lotta” on the basis of decision of Maritime Arbitration Commission of Russian Chamber of Commerce.

The client, who is a maritime agent, has addressed us for professional legal report on the issue of legality of refusal by court of first instance and court of appeal of claim to the charterer by reason of omission of the time limit to bring a claim under contract of maritime agency, which had been concluded with shipowner. The charterer was not a party to maritime agency contract.
Decision
Inspection of case materials has been performed; legal report has been issued about illegality of refusal by the court to hear a claim of maritime agent by reason of omission of the time limit to bring a claim. Case law has been collected which establishes that a person who is not a party to a contract (the charterer), cannot use the arguments and evidence which are available to a person who is a party to a contract (the shipowner). Exact time limits for bringing the claim have been calculated. Points of claim for appeal have been drafted.

The client has addressed us for development of individual contract for freight forwarding services which should protect interests of cargo sender / cargo receiver in cases of delay in delivery of cargo, delays on route and in line for customs procedures, damage to cargo in the process of carriage, and for regulation of other individual requirements.
Decision
A unique contract for freight forwarding services has been drafted, fully corresponding to standard practice of international carriage of goods by road, to national and international law and, finally, to special demands of the client in relation to deadlines for payment for services, methods of notifications in the process of carriage of cargo. Risks of limitation of liability of the freight forwarder / carrier for late delivery of cargo have fully been eliminated. Order of execution of contract has been established and fixed in written form in relation to all its stages, from application for carriage to discharge of cargo at place of delivery.

Representing the interest of Russian agent of cargo senders, we have gathered and evaluated foreign evidence which have confirmed conclusion of carriage contract and sending of cargo. Based on gathered evidence a claim letter has been prepared and sent to the carrier with demand for compensation of damages.In the process of negotiations we have protected interests of the client in contact with lawyers of the carrier. Limited by a short deadline, we have proved actual damage as per rules of law and its real size.As a result parties have reached and formed an agreement about size and period for payment of compensation for loss of cargo. Damages have been compensated as per terms of the named agreement.

Decision
Rules of Korean and Japanese law in relation to arrest of vessels were clarified. A report was issued about correspondence of data and documents which have been presented by the shipowner / lessee to norms of law. Individual form of contract of bareboat charter on terms of leasing has been drafted; support was given in negotiation of the draft by the lessee and lessor.
