Collection of damages for demurrage and worsening of quality of handled cargo
Protection of American exporter of biofuel Evans Holdings LLC against the claim from stevedoring company about payment of handling workd and in counter claim to the stevedoring company to collect damages for demurrage and worsening of quality of handled cargo.
Collection of damages for demurrage and worsening of quality of handled cargo
Stevedoring company brought a claim to collect part of price for performed handling of cargo works. At the same time, the reason of refusal to pay this part of pricewas demurrage of vessels "Sestroretsk" and "Zigfrid Lemann" and due to worsening of quality of handled cargo (biofuel).
Decision
As a result of acknowledgent of mutual claims for both claims of the parties, the court of appeal covered the claim of stevedoring company by claim of "Evans Holdings" LLC. The rest of the counter claim, not covered by mutual acknowledgement, was ordered in favor of "Evans Holdings" LLC, including damages and judicial expenses. The decision was unheld by all instances.

Collection of damages for demurrage and loss of quality of loaded cargo
Protection of exporter company «Ligo Briz» LLC, which exported biofuel from Evans Holdings LLC against a claim from stevedoring company for payment for works of loading and discharge, and provision of help in filing of counter claim for collection of damages from stevedoring company for demurrage and loss of quality of loaded cargo.

Stevedoring company had filed a suit for collection of part of the price of works for loading and discharge of cargo. However the reason for refusal of payment was demurrage of vessels «Sestroretsk» and «Zigfrid Lemann», and loss of quality of loaded cargo (biofuel).
Decision
As a result of set-off of similar claims as per primary suit and cross-action, the court of appeal has agreed that claim of«Ligo Briz» LCC prevailed, and has awarded to company an amount not covered by a set-off, together with litigation expenses. This decision has been upheld by court of final instance.
